RIGHT TO SUBMIT A CLAIM

The consumer has the right to submit a claim about the goods or the service provided, if it does not meet the terms of the contract, 2 within a year from the date of purchase.

The claimant must have a document proving the purchase of the purchased product and service, on the basis of which the buyer proves the date of purchase.

If from the purchase of goods or services for which the consumer has filed a claim, 6 months have passed, the trader is obliged to prove the truth of the claim. However, after 6 months have passed, the consumer is required to prove that a hidden defect or other non-compliance with the terms of the contract already existed when the goods or services were purchased.

If it turns out that the goods or services have a manufacturing defect, the trader must repair or replace the item. If the repair fails and replacement is not possible, the consumer has the right to withdraw from the contract and get a refund.

GUARANTEE

The new products sold by CALROB IT OÜ (avutipunkt.ee) are subject to VÕs § 218 paragraph 2, the 2-year deadline for submitting a claim. A longer warranty period may be established by the manufacturer - in this case, it is indicated with the product and on the sales invoice. The period for submitting claims starts from the date indicated on the shipping document drawn up at the time of delivery of the goods to the customer. Within 2 years, we will repair the defective product free of charge, provided that the fault is caused by the manufacturer and the customer provides the original purchase document. If the product cannot be repaired, the customer has the right to demand product replacement or withdraw from the contract. The above applies on the condition that the product has been used only under the conditions and for the intended purpose, and the fault is not caused by external conditions (lightning, voltage fluctuation, insufficient ventilation, leaked batteries, fire, flood, etc.) or improper handling of the product. The right to demand free repair of the product expires before the end of 2 years if: a. when bringing the product for repair, the purchase document for the product in need of repair is not presented or if the data on it has been changed arbitrarily; b. the serial and model number of the product has been altered, removed, misplaced or illegible; c. the design of the product has been changed arbitrarily, regardless of the extent or how qualified it has been done, or if the product has been taken for repair elsewhere than at the manufacturer's representative office or a repair shop accepted by us; d. the product went out of order due to the user's fault as a result of incorrect operation, as well as in case of defects caused by not following the user manual or careless storage of the product. In the event that the goods purchased by the consumer show a defect for which the seller is responsible (VÕS § 218 pt. 2), the seller will organize the transport to the customer's location and back (VÕS § 222 pt. 4).

The warranty is valid in the territory of the Republic of Estonia.< /p>

Expertise carried out by the maintenance department of konturipunkt.ee (in some cases also by the company importing the product) to find out the presence and cause of a defect in the product.

Independent expertise – an additional fee-based expertise carried out by an independent expert at the customer's request in the event , if the customer is not satisfied with the results of the examination carried out by avrutipunkt.ee.

The warranty covers construction, production and material errors and the repair costs of defects caused to the device due to these errors.

The warranty period starts from from handing over to the buyer and is valid until the period specified by the manufacturer of the goods.

The following sales warranty terms and conditions apply to the products:

the computer sales warranty is 24 months*

computer accessories, also those that are assembled according to a special order when purchasing or upgrading a computer later have a 12-month sales guarantee

external devices (printers, scanners, keyboards, mice, etc.) and separately purchased parts have a 12-month sales guarantee

the document certifying the validity of the warranty of the purchased product is the sales invoice

* unless otherwise stated in the price list valid at the time of purchase.

THE SALES GUARANTEE DOES NOT EXTEND:

to diskettes, CD/DVD discs, packaging, documentation, consumables, licenses, software and installation media;

disruptions in the operation of the product caused by its accidental or intentional damage by the user;

disruptions in the operation of the device, caused by changing the technical characteristics of the device, carried out by a person or service not certified by the manufacturer;

operating malfunctions caused by disregarding the product's user manual;

for errors caused by the software;

for device cleaning;

for training in the use of the device;

This also includes computer parts improperly handled by the customer or third parties;

 

disruptions in the operation of the device due to thunder or some other natural phenomenon (force majeure);

Computer malfunctions caused by the product of computer components and from the customer's disregard of the parameters set by;

assembled on a desktop computer whose warranty sticker has broken due to the fault of the consumer. In this case, only the 24-month claim submission period applies;

for disturbances caused by connecting a computer or other device to an improper power network (including an ungrounded power network);

failures in the operation of the product due to the connection of live devices;

interruptions caused by software installed by the customer in the product;

computer malfunctions caused by the client's disregard of the parameters set by the manufacturer for computer components;

assembled on a desktop computer that has been resold to another consumer (the computer has changed ownership).

CALROBIT OÜ IS NOT RESPONSIBLE:

for the preservation of the information on the device brought for repair, as well as if the data or software on the computer is damaged or damaged during the warranty repair. Data backup is the customer's responsibility.

for failure to eliminate product defects in the event that the defect did not appear during the warranty repair and its occurrence was not registered when the product was brought for warranty repair.

During the warranty period given by the manufacturer/seller for the product, the customer may submit CALROB IT A claim to OÜ regarding circumstances preventing the intended use or storage of the goods, which are caused by defects in the quality of the goods. The resolution of the consumer's claim is carried out in accordance with the current legislation.

The claim must be submitted in Estonian and described as clearly as possible about the defect in the product.

The consumer's claim cannot be resolved if CALROB IT OÜ proves that the defects the consumer's fault has arisen during the use of the goods.

CALROB IT OÜ is obliged to carry out an examination at the customer's request or, if necessary, order an independent examination to find out the causes of the defect in the item. If the examination reveals that the part is in order or the defect is not covered by the warranty, the customer pays the examination costs.

The buyer pays the costs incurred in connection with the equipment brought in for warranty service without a reason (if the failure is not caused by scrap from the manufacturer or the product's warranty conditions have been violated) (applies only if 6 months have passed since the delivery of the item to the consumer).

In this case, CALROB IT OÜ has the right to present the customer with an invoice for the work performed so far according to the current price list.

Warranty replacement . If the repair of the product turns out to be impossible, or its production has been discontinued, CALROB IT OÜ assumes the right (with the customer's consent) to replace the product with an equivalent one.

A new warranty with the same duration as the original sales warranty is given to the replaced item during the warranty period.

In case of repair of the device during the warranty period, the (sales) warranty is extended by the duration of the repair time.

The sales warranty does not exclude or limit the buyer's right to use other legal remedies arising from the law or the contract.
